These Terms and Conditions govern the use of the PromptPageAI service operated by PromptPageAI UG (haftungsbeschränkt) ("Provider"). For clarity in this document, the Provider is also referred to as "Tippel". By using the service, you ("Customer") agree to these Terms.
The Provider offers an online service for creating website previews and, after activation ("going live"), hosting the website on infrastructure managed by the Provider.
The Customer acknowledges and agrees that:
The Customer is solely and fully responsible for all content placed on, or made available through, the website, including its accuracy, legality, and compliance with applicable laws (e.g., copyright, trademark, unfair competition, consumer protection, e-commerce, and privacy laws). The Provider does not pre-screen or monitor content and assumes no responsibility for it. The Customer warrants that their content does not infringe third-party rights and complies with all applicable regulations.
The Customer shall indemnify, defend, and hold harmless the Provider, its directors, employees, and agents against any claims, damages, liabilities, penalties, costs, and expenses (including reasonable legal fees) arising out of or related to the Customer's content or use of the service.
The service is provided "as is" and "as available". The Provider explicitly makes no promise, representation, or guarantee of uptime, availability, or uninterrupted service. Planned and unplanned downtime may occur at any time. To the maximum extent permitted by law, the Provider disclaims all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Creating a preview is free. Going live requires a paid subscription ($54.90/month or $549/year). Change requests after going live cost $4.99 per request. Prices are shown in USD unless stated otherwise and may change prospectively.
To the maximum extent permitted by law, the Provider shall not be liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits, lost data, business interruption, or reputational harm), nor for any damages related to downtime, domain issues, third-party failures (registrar, hosting, CDN, payment providers), or force majeure.
In any case, and to the extent liability cannot be excluded, the Provider's aggregate liability shall not exceed the total fees paid by the Customer to the Provider for the service in the twelve (12) months preceding the event giving rise to the claim. Mandatory statutory liability (e.g., for intent or gross negligence, bodily injury) remains unaffected where such limitations are not permitted by law.
The Provider may, at its reasonable discretion and without liability, modify, suspend, or remove the website or specific content where necessary to address legal risks, third-party rights complaints, non-payment, security concerns, or violations of these Terms.
Consumers may have a statutory right of withdrawal within 14 days of contract conclusion. Services that are fully performed before the withdrawal period ends (e.g., domain registration) are excluded from withdrawal where allowed by law.
The Privacy Policy is available at Privacy. For going live and ongoing service, data may be shared with domain registries/registrars and payment providers as required for performance of the contract.
Monthly subscriptions can be cancelled effective at the end of the current billing period. Yearly subscriptions have a 12-month minimum term. Upon termination or cancellation, the Customer's license ends, hosted access may be disabled, and domains remain owned and controlled by the Provider unless a separate, agreed transfer is completed.
The Provider may update these Terms. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
German law applies. The exclusive place of jurisdiction—where legally permissible—is the registered office of the Provider.
